1. Acceptance of Terms

By accessing or using WealthPlannr, you agree to be bound by these Terms of Service, our Privacy Policy, and our Financial Disclaimer below. If you do not agree, you must stop using the platform immediately.

2. Service Description

WealthPlannr is a Software-as-a-Service (SaaS) platform for financial planning and simulation. We do not provide regulated financial, investment, or tax advice.

3. Legal Nature of Service (AFM Disclaimer)

No Financial Advice: This platform does not provide regulated investment, tax, or legal advice. We do not assess your personal risk tolerance or suitability for specific financial products. Consult a certified belastingadviseur (RB/FB) or financial planner before making decisions.

AI Limitations: Outputs are generated by Generative AI. While we use proprietary fiscal logic for 2026 Dutch tax calculations, AI may still produce errors. The user remains solely responsible for the accuracy of data submitted to the Belastingdienst.

Tegenbewijs Evidence Reports: Box 3 Defender reports are tools to support your Tegenbewijs filing. They do not constitute professional tax advice. Always verify extracted figures against official bank and brokerage statements before submission.

4. AI Transparency (EU AI Act Compliance)

WealthPlannr uses General Purpose AI Models (Anthropic Claude) to assist in document processing and financial analysis. In compliance with the EU AI Act:

• AI Labeling: All AI-generated text is marked with a “Generated by WealthPlannr AI” badge.
• Model Disclosure: Document extraction uses Anthropic Claude (General Purpose AI Model).
• Human Oversight: All AI-extracted data can be manually edited and must be confirmed by the user before generating any reports. No fully automated decision-making with legal effect takes place.
• No Training on Your Data: Your financial documents are never used to train or improve AI models.

5. Subscriptions & Payments

Fees for premium features are billed in advance via Stripe. You may cancel your subscription at any time. No refunds are provided for partial months of service unless required by Dutch consumer law (Wet Koop op Afstand).

6. User Conduct

You agree not to use the platform for any illegal activities, to submit fraudulent data to tax authorities using our tools, or to attempt to reverse-engineer the simulation logic. The tool is for personal or private business (DGA) planning use only.

7. Professional Use (Belastingadviseurs & Accountants)

If you use WealthPlannr to process data on behalf of your clients, you act as the Data Controller and WealthPlannr acts as the Data Processor. You must accept our Data Processing Agreement (Verwerkersovereenkomst) before processing client data. You are responsible for obtaining appropriate consent from your clients for data processing.

8. Limitation of Liability

WealthPlannr is provided “as is.” We are not liable for any financial losses, investment failures, tax penalties, or any other damages resulting from the use of our estimates, simulations, or AI-generated outputs. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in Amsterdam.

2. Beschrijving van Dienstverlening

WealthPlannr is een Software-as-a-Service (SaaS) platform voor financiële planning en simulatie. Wij verstrekken geen gereguleerd financieel-, beleggings- of belastingadvies.

3. Juridische Aard van de Dienst (AFM-Disclaimer)

Geen financieel advies: Dit platform biedt geen gereguleerd beleggings-, belasting- of juridisch advies. Wij beoordelen niet uw persoonlijke risicotolerantie of geschiktheid voor specifieke financiële producten. Raadpleeg een gecertificeerde belastingadviseur (RB/FB) of financiële planner alvorens beslissingen te nemen.

AI-beperkingen: Uitvoer wordt gegenereerd door Generatieve AI. Hoewel wij eigen fiscale logica gebruiken voor Nederlandse belastingberekeningen 2026, kan AI fouten produceren. De gebruiker blijft volledig verantwoordelijk voor de juistheid van bij de Belastingdienst ingediende gegevens.

4. AI-Transparantie (EU AI Act)

WealthPlannr maakt gebruik van General Purpose AI-modellen (Anthropic Claude) om te assisteren bij documentverwerking en financiële analyse. Conform de EU AI Act:

• AI-labeling: Alle door AI gegenereerde tekst wordt gemarkeerd met een “Generated by WealthPlannr AI”-badge.
• Modeltransparantie: Documentextractie gebruikt Anthropic Claude (General Purpose AI Model).
• Menselijk toezicht: Alle door AI geëxtraheerde gegevens kunnen handmatig worden bewerkt en moeten door de gebruiker worden bevestigd voordat rapporten worden gegenereerd.
• Geen training: Uw financiële documenten worden nooit gebruikt om AI-modellen te trainen of verbeteren.

5. Abonnementen en Betalingen

Kosten voor premium functionaliteiten worden vooraf gefactureerd via Stripe. U kunt uw abonnement op elk moment opzeggen. Er worden geen terugbetalingen gedaan voor gedeeltelijke maanden, tenzij vereist door de Nederlandse Wet Koop op Afstand.

6. Gebruiksvoorschriften

U gaat ermee akkoord het platform niet te gebruiken voor illegale activiteiten, geen frauduleuze gegevens via onze tools bij belastingautoriteiten in te dienen, en niet te proberen de simulatie-logica te decompileren. De tool is uitsluitend bedoeld voor persoonlijke of private zakelijke (DGA) planning.

7. Professioneel Gebruik (Belastingadviseurs & Accountants)

Indien u WealthPlannr gebruikt om gegevens namens uw cliënten te verwerken, treedt u op als Verwerkingsverantwoordelijke en WealthPlannr als Verwerker. U dient onze Verwerkersovereenkomst te accepteren vóór verwerking van cliëntgegevens.

8. Beperking van Aansprakelijkheid

WealthPlannr wordt geleverd “zoals het is”. Wij zijn niet aansprakelijk voor financiële verliezen, mislukte beleggingen, belastingboetes of andere schade voortvloeiend uit het gebruik van onze schattingen, simulaties of AI-gegenereerde uitvoer.

9. Toepasselijk Recht

Op deze Voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter te Amsterdam.
